TERMS AND CONDITIONS
1. SUBJECT
1.1. These General Conditions of Online Sale (hereinafter "GCS") govern the contract (hereinafter the "CONTRACT") for the sale of clothing and accessories products exclusively distinguished by the NUMEROTREBOUTIQUE store (hereinafter "PRODUCTS") offered by NUMEROTREBOUTIQUE di Manuela Tano, with registered office in Via Montemarcone 45 Atessa ( CH) 66040, VAT number IT02726760693 (hereinafter " NUMEROTREBOUTIQUE "), through its website www.numerotreboutique.com (hereinafter "SITE") to users of the SITE (hereinafter "CUSTOMER" or "CUSTOMERS").

In these GCS, the term CUSTOMER or CUSTOMERS means the "consumer" or "consumers" as per article 3, co. 1, lett. a), of Legislative Decree 6 September 2005, n. 206 (hereinafter "CODE"), ie the natural person who acts for purposes unrelated to the entrepreneurial or professional activity possibly carried out.
2. EFFECTIVENESS AND MODIFICATION OF THE GCS
2.1. The GCS are available on the SITE to be easily read by the CUSTOMER before registering and before making the purchase of the PRODUCTS; they are considered accepted together with the registration and forwarding of the purchase order form, and can be stored on the CUSTOMER's computer and reproduced on paper by printing the file in which they are contained.
2.2. The GCS applicable to the sale of the PRODUCTS are those published on the SITE, on the date of the order relating to the PRODUCTS. The CUSTOMER, therefore, must read the GCS, every time he intends to make a purchase on the SITE.
2.3. The mere tolerance or failure by NUMEROTREBOUTIQUE of any non-fulfillment by the CUSTOMER with respect to what is contained in the GCS cannot be interpreted as tacit acceptance of such non-fulfillment, nor as a desire to derogate from what has been agreed between the parties.
3. REGISTRATION AND PURCHASE PROCEDURE
3.1. The CUSTOMER who intends to proceed with the purchase of the PRODUCTS must express this will by registering his data and a request made directly on the SITE where, following the purchase procedure indicated therein, he will forward, electronically, his electronic order. purchase order (hereinafter "ORDER") and the relative payment, except as specifically regulated in article 7.4.
3.2. 3.3. The CUSTOMER can access his order form by consulting the section "MY ORDERS" in "MY ACCOUNT" and if he wishes to cancel the ORDER or modify the ORDER by increasing, decreasing the quantity of PRODUCTS previously ordered, or simply by modifying, inserting new items in addition to or replacing the PRODUCTS themselves, you must necessarily write to us through the contact form provided that the relative shipment has not already been confirmed by NUMEROTREBOUTIQUE with an e-mail confirming shipment (hereinafter "SHIPPING CONFIRMATION") referred to in the following article 3.5.
3.4. Once the ORDER has been received, NUMEROTREBOUTIQUE will send the CUSTOMER an e-mail confirming the order (hereinafter "ORDER CONFIRMATION"), containing a summary of the content of the information relating to the sale, and will proceed to fulfill the ORDER , without prejudice to the provisions of article 3.6 below.
3.5. All purchase orders for PRODUCTS are subject to their availability and, therefore, to the confirmation of NUMEROTREBOUTIQUE , which will communicate this availability by sending an e-mail to the CUSTOMER to CONFIRM SHIPPING.
3.6. In case of non-execution of the ORDER, due to the unavailability of one of the PRODUCTS ordered, NUMEROTREBOUTIQUE will inform the CUSTOMER via e-mail and will ask for confirmation of the CUSTOMER ORDER, for the purchase of the remaining PRODUCTS available. In any case, the unavailability of one or more of the PRODUCTS ordered will not automatically give the CUSTOMER the right to cancel the entire ORDER.
3.7. The CONTRACT between the CUSTOMER and Numerotreboutique is governed by the ORDER, by the SHIPPING CONFIRMATION and by the GCS (the latter published on the SITE), as well as by the Privacy Policy and by the E-commerce Information (hereinafter cumulatively "PRIVACY") both published on the SITE.
4.RIGHTS AND OBLIGATIONS OF NUMERO TRE BOUTIQUE
4.1. NUMEROTREBOUTIQUE undertakes to deliver the PRODUCTS in Italy to the address and within the terms indicated by the CUSTOMER in the ORDER. NUMEROTREBOUTIQUE will not be responsible for delivery errors due to inaccuracies or incompleteness in completing the ORDER or for the CUSTOMER being unavailable. Delivery cannot be made to PO boxes.
4.2. In case of return, total or partial, of the PRODUCTS by virtue of the right of withdrawal or the guarantee required by law, NUMEROTREBOUTIQUE , in accordance with the provisions of the following articles 9 and 10, will only refund the sums due, as neither foreseen nor changes nor replacements.
5. RIGHTS AND OBLIGATIONS OF THE CUSTOMER

5.2. The CUSTOMER, while registering and sending the ORDER, declares to have read, understood and accepted the GCS and the additional information contained in the SITE, in particular in the "Customer Service" section, including the PRIVACY; to be an adult, in possession of the legal capacity to act.
5.3. The CUSTOMER undertakes, once the purchase procedure on the SITE has been completed, to provide for both the saving of an electronic copy and the printing of the ORDER and the GCS for the purposes of their conservation, as indicated in the previous article 2.1.
6. USE OF THE SITE
6.1. The essential characteristics of the PRODUCTS are presented on the SITE within each product sheet. The images and colors of the products offered for sale on the SITE may not correspond perfectly to the real ones, as computer screens vary. Therefore NUMEROTREBOUTIQUE cannot guarantee that the color displayed on the CUSTOMER's monitor is perfectly corresponding to the real color of the PRODUCTS.
6.2. NUMEROTREBOUTIQUE assumes no responsibility for the problems caused to the CUSTOMER by the use of the SITE and the technologies used as they are not dependent on their will, such as, by way of example: a) errors, delays or inability to access the SITE by the CUSTOMER on the occasion of the execution of the sale procedure; b) errors, delays or inability to receive, by the CUSTOMER, the communications made by NUMEROTREBOUTIQUE in relation to the sale of the PRODUCTS.
6.3. In any case, NUMEROTREBOUTIQUE through its Customer Service, undertakes, as far as possible, to solve the problems that may occur and to offer the necessary assistance to the CUSTOMER to obtain a quick and satisfactory solution to the aforementioned problems.
7.PRICES AND PAYMENTS
7.1. The prices of the PRODUCTS are those actually displayed on the SITE at the time of placing the ORDER and, unless otherwise specified, are inclusive of VAT. delivery of the same, which will be duly highlighted and summarized before the order is issued and subsequently also in the ORDER CONFIRMATION.
7.2. The total price for the purchase of the PRODUCTS and the shipping and delivery costs, as indicated in the ORDER, will be charged to the CUSTOMER only at the time of shipment of the PRODUCTS, after sending the SHIPMENT CONFIRMATION.

8. DELIVERY OF PRODUCTS TO CUSTOMERS
8.1. Upon delivery of the PRODUCTS to the CUSTOMER by the courier in charge of their transport, the CUSTOMER must check: a) that the quantity and type of PRODUCTS ordered corresponds to what is indicated in the transport document; b) that the packaging used for transport is intact, not damaged, wet or otherwise altered, even only in the closing materials.
8.2. Any anomalies must be immediately reported to the courier upon receipt of the PRODUCTS, by indicating them in the delivery note. The CUSTOMER, in order to facilitate and speed up the procedure for checking any anomalies by NUMEROTREBOUTIQUE, can contact us through the form .
8.3. In the case of cash on delivery payment, referred to in article 7.3. Above, at the time of delivery, the CUSTOMER must already have the exact amount of the ORDER available in Euros, including shipping costs and additional costs. provided for the chosen delivery method, as also summarized in the ORDER CONFIRMATION. The courier will not accept checks, nor will he be able to give change. In the event of a refund, it will in any case be necessary for the CUSTOMER to have a bank or postal current account.
9. RIGHT OF WITHDRAWAL
9.1. The CUSTOMER has the right to withdraw from the contract concluded with NUMEROTREBOUTIQUE , without any penalty and without specifying the reason, within 14 (fourteen) working days from the date of delivery of the PRODUCTS, provided that the return procedure referred to herein is respected. article and that the products to be returned (hereinafter "RETURNED PRODUCTS") are intact, never worn, complete with their original packaging, tags and labels as better regulated in the following article 11. It is not possible to replace the product to be returned with another.
9.2. In case of exercise of the right of withdrawal, even partial, the only costs charged to the CUSTOMER will be those for returning the RETURNED PRODUCTS which must be made in a single solution.

3) at this point the CUSTOMER can, alternatively:
a) call the courier indicated by NUMEROTREBOUTIQUE in the return authorization email, to book the collection of the package and agree on the date, time and place of collection of the return. In this case, the CUSTOMER will not have to personally pay the costs of returning the RETURNED PRODUCTS, however at his own expense, which will instead be made on his behalf, directly by NUMEROTREBOUTIQUE . NUMEROTREBOUTIQUE , in fact, will deduct from the refund due to the CUSTOMER, an amount equal to the cost previously incurred by the CUSTOMER for the shipment and delivery of the purchased products. In this case, NUMEROTREBOUTIQUE will be responsible for any liability in case of loss or damage to the RETURNED PRODUCTS during transport.

b) choose a courier other than the one used by NUMEROTREBOUTIQUE and send the RETURNED PRODUCTS to NUMEROTREBOUTIQUE , no later than 14 (fourteen) working days from receipt of the return authorization e-mail. The CUSTOMER must personally pay the return costs, at his own expense, of the RETURNED PRODUCTS. NUMEROTREBOUTIQUE , therefore, will also reimburse the CUSTOMER the cost previously incurred for the shipment and delivery of the purchased products. In this case, the CUSTOMER will be responsible for any responsibility in case of loss or damage to the RETURNED PRODUCTS during transport.
9.5. If the right of withdrawal is exercised following the methods and terms indicated in this article , NUMEROTREBOUTIQUE will reimburse the CUSTOMER for any sums already collected for the purchase of the RETURNED PRODUCTS according to the methods and terms provided and in any case, within 14 ( fourteen) days from the day on which NUMEROTREBOUTIQUE is informed of the consumer's decision to withdraw. NUMEROTREBOUTIQUE , in the event that the CUSTOMER has chosen to send the RETURNED PRODUCTS through the option referred to in letter b) above, may withhold the refund until he has received the RETURNED PRODUCTS or until the CUSTOMER has demonstrated that he has returned them, to whichever situation occurs first.
9.6. If the methods and terms for exercising the right of withdrawal are not respected, as specified in this article, the CUSTOMER will not be entitled to a refund of the sums already paid to NUMEROTREBOUTIQUE . However, you can get back, at your own expense, the RETURNED PRODUCTS in the state in which they were returned to NUMEROTREBPUTIQUE. Otherwise, NUMEROTREBOUTIQUE may withhold the RETURNED PRODUCTS, in addition to the sums already paid for their purchase.
10.RETURN FOR DEFECTS OR DIFFERENCES OF THE PRODUCTS

10.3. In the case of defective products or products different from those ordered (hereinafter "DEFECTIVE PRODUCTS"), the CUSTOMER, without any exception, must:

3) call the courier of reference in the nearest branch to book the collection of the package and agree on the date, time and place of collection of the return. 10.4. If the return for DEFECTIVE PRODUCTS is exercised following the methods and terms indicated in this article, NUMEROTREBOUTIQUE will reimburse the CUSTOMER, by bank procedure, within 30 (thirty) days from the date of receipt of the DEFECTIVE PRODUCTS, the costs incurred by the CUSTOMER. for the purchase of the same products and for the relative shipping and delivery costs.
11.INTEGRITY OF PRODUCTS
All PRODUCTS come with an identification tag, internal labels and their own packaging.
